Managing Pay Issues – Holiday Pay and Other Current Problems (Norwich), Ashtons Legal Solicitors Norwich, Tuesday, 10. December 2019

Holiday pay remains in our view a very sticky subject and one that continues to prove challenging for employers. In this workshop, we will cover current issues that arise with holiday pay, including commission, overtime, bonuses and atypical workers. We will also look at recent case law which has cast some shadow on the legislation that prevents employees from claiming untaken holiday pay for more than two years. We will also look at some other tricky pay issues, including the drafting and execution of TUPE This masterclass is designed to be a definitive guide to the application and operation of the Transfer of Undertakings (Protection of Employment Regulations) 2006. Topics will include: Identifying a relevant transfer; the effect of the transfer; what happens to collective agreement and trade union recognition; TUPE in an insolvency context; changing terms and conditions of employment following a transfer; dismissal because of a relevant transfer; employee liability information; duty to inform and consult; and the future of the regulations. The masterclass will end by looking at a detailed case study based on an actual case that was heard in the Employment Tribunal over 25 days and on which the speaker advised.
